Can AI Disruption Justify Firing an Employee? A Chinese Court Says NO

作者:王忻媛 来源:中国青年报客户端2026年05月29日

A Hangzhou court ruled that dismissing a worker simply due to “AI impact” is illegal. The employer argued that technological advances made the position redundant, but the judge held that AI has not yet reached the point of fully replacing human roles. More importantly, the court stressed that companies must first try retraining, reassignment, or other adjustments before resorting to layoffs. The employer was ordered to pay over $36,000 in compensation.(Photo/AI)
